Scott Kempe vs. City of Cape Coral

Many were led to believe that the City’s insurance policy through the Florida Municipal Insurance Trust would cover the $100,000 settlement to Scott Kempe. In reality, this was another misleading narrative from city officials. The taxpayers (not John Gunter, the responsible party) footed the bill. Why? The policy includes a $100,000 self-insured retention (deductible), specifically designed for situations like this involving alleged abuses of power by city leadership.


In March 2024, Mayor John Gunter had Scott Kempe arrested during a peaceful protest. For many, this came as no surprise—Gunter has shown a pattern of silencing dissent and avoiding public criticism. It was yet another instance where City Hall acted without accountability, expecting citizens to stay silent.


Lee County prosecutors later dismissed the charges against Kempe.

Kempe had filed for a preliminary injunction to prevent the City of Cape Coral and its City Council from banning individuals from public meetings based on past behavior. He is also seeking:

• Compensatory damages

• Injunctive relief

• Declaratory judgment

• Invalidation of official acts taken in violation of Florida law

• Interest, nominal damages, attorney fees, costs, and any other relief deemed appropriate by the Court


The City quickly determined that offering the $100,000 settlement would cost less than going to trial, where a judgment could result in significantly higher damages.

Should John Gunter repay the taxpayers?


Scott Kempe passed away after the settlement. We may not know the exact cause, but what’s clear is that the immense stress and pressure brought on by John Gunter and the city took a heavy toll. No one should have to endure that, and it’s heartbreaking to think of what he went through.
